Infringement Notices

Company fined for failing to comply with requirements of recall notice

Alleged contraventions: Section 105 of the Agvet Code

The Australian Pesticides and Veterinary Medicines Authority (APVMA) has issued an infringement notice to a company for failing to comply with an APVMA issued recall notice, which is a contravention of section 105 of the Agvet Code.

On 8 April 2020 the APVMA issued a recall notice to the company in relation to non-compliance with labelling requirements. The APVMA had reasonable grounds to believe that the company had not complied with all of the requirements of the recall notice and on 31 July 2020 issued an infringement notice in the fixed amount of $63,000 to the company.

The company paid the infringement notices on 7 August 2020, and continues to cooperate with the APVMA.

The APVMA takes non-compliance with labelling requirements and recall notices conditions seriously. This infringement notices serves as a reminder that entities issued recall notices are expected to comply with the instructions given.

On 14 September 2020 Katpet Pty Ltd made an enforceable undertaking to the APVMA. Pursuant to subsection 145E (6) of the Agricultural and Veterinary Chemicals Code as scheduled to the Agricultural and Veterinary Chemicals Code Act 1994, the enforceable undertaking has been published.

September 2020

On 2 September 2020 Fluidra Group Australia Pty Ltd made an enforceable undertaking to the APVMA. Pursuant to subsection 145E (6) of the Agricultural and Veterinary Chemicals Code as scheduled to the Agricultural and Veterinary Chemicals Code Act 1994, the enforceable undertaking has been published.
