In some circumstances, the Australian Pesticides and Veterinary Medicines Authority (APVMA) may exempt chemical products from possession and supply offences of the Agvet Code (sections 75 and 78) for a specified period. These powers are exercised on a case-by-case basis and may be subject to certain conditions.
Chemical products that are exempt from the possession and supply offences of the Agvet Code are not registered chemical products and cannot be advertised.
Exemptions are generally considered an interim solution while other arrangements are being effected.
Under the Agvet Code, a holder cannot apply for an exemption – only the APVMA can issue an exemption.
An exemption will not be granted if the statutory criteria are not met.
There are currently no exemptions in force.
