The following list generally includes chemicals that have not been primarily developed as agricultural or veterinary chemicals and thus do not have an extensive package of data (as would usually be provided for a new active constituent) readily available. Many are commodity or speciality chemicals.

These active constituents have been exempted from the requirement for approval (that is, exempted from the operation of section 15(1)(a)(i) of the Agvet Code), through a formal process involving a gazettal of the active as exempt from approval. This list has not been added to for a number of years and the Australian Pesticides and Veterinary Medicines Authority (APVMA) is not routinely considering new exemptions. Approval by the APVMA of active constituents in this list is not required.

Agricultural or veterinary chemical products containing active constituents exempted from approval that fall within the scope of APVMA legislation must still be registered with the APVMA before these products can be legally sold, distributed or used in Australia. Supporting data appropriate to the application item must be provided.

Exempt active constituents can be obtained from any source capable of manufacturing the active to a specification suitable for use in the registered product. A manufacturing site address for an exempt active is not required on the application form for product registration.

A copy of the specifications to which the active is supplied, and a certificate of analysis confirming compliance with the specifications, must be provided as part of the chemistry data package to verify that the active is of acceptable quality for use in the product. In some instances, the APVMA has established standards for exempt actives (for example, pyrethrum extract, copper sulfate), and the active must comply with that standard.

Exempt active constituents do not have approval numbers associated with them and do not appear in the APVMA’s PubCRIS database.

Any chemicals that are not approved, or exempted from approval, cannot be used as active constituents in an agricultural or veterinary chemical product, unless an application is made for approval of the active.
